Minnesota has legislation in place affecting current employers:

Executive Order 08-01 enacted on 1/29/2008

  • Requires certifications from state vendors and their subcontractors that each “has implemented or is in the process of implementing” E-Verify for all newly hired employees in the U.S. who will work “on behalf of the state of Minnesota”.  The legislation is broader than other similar measures in that it is very broad and conceivably applicable to multiple layers of subcontractors, agents, and independent contractors fulfilling contracts.  Businesses with EXISTING state contracts are not required to implement E-verify but the order recommends it, and it could have a potentially huge impact in geriatric care sector, where the majority of state-funded care is delivered via multiple layers of subcontracting.
